Variance Revocation, CTS Inc.

Sept. 1, 2020 - The Department of Consumer and Business Services, pursuant to OAR 437-001-0430, hereby gives notice that Variance V-001-17, originally issued on May 3, 2017, to CTS Inc., is being revoked.

Research variance V-001-17 was granted to field verify the safe operation of a tethered logging system used in conjunction with a steep-slope feller buncher. To facilitate the collection of research data to verify safe operation of new tethered logging technology on slopes over 50 percent, provision 16 of the variance requires the employer to provide a research variance report to Oregon OSHA on a semi-annual basis during each January and July while the variance is in effect. Such reports must include recordable injuries incurred during tethered logging operations.

Research variance V-001-17 is being revoked due to the employer’s failure to comply with provision 16, as shown by one or more of the following:

  • Tethering review reports were submitted untimely to Oregon OSHA for reporting periods during January 2018 through December 2019. 
  • An employee was seriously injured on October 17, 2019 while performing an activity covered under the variance. The report submitted by the employer for the time period that the injury occurred did not include this information as required.
  • A tethering review report was not submitted to Oregon OSHA for reporting period January through June 2020.

This variance is proposed to be revoked on October 5, 2020.

Anyone wishing to express views or arguments, orally or in writing, must submit a written request for a public hearing within 20 days of the date of this notice, along with written comments to the address provided. A public hearing will be held if the division receives requests from ten or more people or from an association with ten or more members. If sufficient requests are received to hold a public hearing, interested persons will be notified of the date and time of the hearing.
