Worker Protection Standard Details Delay Decision

Oregon OSHA is delaying a decision on the details of the adoption of its proposed changes to the Worker Protection Standard (WPS) until January 31, 2017, in order to give the comments received due consideration. The proposed changes are in response to the Environmental Protection Agency’s revisions of 40 CFR 170 at the federal level.

Oregon OSHA’s rulemaking has involved the Small Agricultural Employer Advisory Committee and other stakeholders who contributed substantial time and valuable input to the process. In addition, Oregon OSHA held three public hearings around the state and accepted public comment through December 14, 2016.

In the interim, employers must continue to comply with the existing Worker Protection Standard, adopted by reference in Oregon OSHA’s Division 4/W, 170.1 -170.260. The WPS is also referenced in Division 2/Z and in Division 7/A.
