Annual Adjustment of Civil Penalties Rule Advisory Group

Oregon OSHA is rulemaking to revise Division 1, OAR 437-001-0142, Annual Adjustment of Civil Penalties. Due to the 2025 lapse in appropriations by the U.S. Congress, and resulting suspension of federal government services (government shutdown), the division already did temporary rulemaking, that was adopted on November 21, 2025, to adjust the rule in response to uncertainties in the availability of the U.S. Bureau of Labor Statistics (BLS) data for the Consumer Price Index for All Urban Consumers, West Region, All Items (West Region CPI-U). As a result, the division is engaging in the permanent rulemaking process to revise the BLS CPI-U data time period of October to October of each year, to better ensure any future BLS data disruption does not affect the division's requirement to maintain alignment with the statutory requirement under ORS 654.086(4).
