Comparison of proposed permanent rule and existing temporary rule

April 6, 2021 - The public comment period for “Oregon OSHA’s Proposal on Rules Addressing the COVID-19 Public Health Emergency in All Oregon Workplaces” closed April 2, with more than 5,000 comments that are still being logged. We expect to make a decision before the existing rule expires on May 4. We have previously committed that anything required by the new rule that is not required by the existing temporary rule will have a delayed effective date. We are not taking any more feedback and we will not be able to provide any more specific details regarding timing of the decision.

Petition to Amend 437-004-1120 Agricultural Labor Housing and Related Facilities in response to the COVID-19 temporary rule (Jan. 4, 2021)

The Temporary rule addressing the COVID-19 emergency in employer-provided housing, labor-intensive agricultural operations, and agricultural transportation was set to expire on October 24, 2020. On October 23, 2020 Governor Brown issued an Executive Order (20-58) extending the requirements of employer-provided housing (Section 2) of the Temporary Rule. Labor-intensive agricultural operation (Section 1) and agricultural transportation (Section 3) of the temporary rule expired on October 24, 2020 and are no longer in effect.
