SB 592 was passed with an “emergency” adoption clause, which means Oregon OSHA must rapidly perform administrative rulemaking to align with the statutory changes introduced by SB 592. That work entails assembling a rule advisory committee and engaging in a public comment process to gather input on the proposed rules that would implement these changes.
Oregon OSHA last updated its penalty structure in 2021, which brought penalties into line with federal OSHA's maximum penalties in effect at that time. Oregon OSHA had originally proposed penalty adjustments in February 2020, but the COVID-19 pandemic forced a delay in the rulemaking adoption until November 2021.
The penalty increases prompted by SB 592 temporarily align Oregon OSHA with federal OSHA's 2023 penalty schedule. However, Oregon OSHA will need to annually adjust its penalties based on changes in the Western Region Consumer Price Index (CPI-WR) rather than the national Consumer Price Index for All Urban Consumers (CPI-U), which is used by federal OSHA to annually adjust its penalties.
